BEFORE: JONES and WELLFORD, Circuit Judges; and RUBIN, Chief District Judge* Order The plaintiff requests leave to proceed in forma pauperis and moves for a summary reversal in his appeal from the dismissal of his civil rights complaint. This appeal has been referred to a panel of the Court pursuant to Rule 9(a), Rules of the Sixth Circuit, which upon examination of the record and the plaintiff's brief, agrees unanimously that oral argument is not needed. Rule 34(a), Federal Rules of Appellate Procedure. On December 16, 1982, Rush filed a civil rights complaint and a motion to proceed in forma pauperis with an affidavit of poverty which is identical to the one filed in a previous civil rights action (Sixth Circuit case number 83-3041). As it had done in that previous action, the district court denied Rush's request for pauper status andd dismissed the complaint without prejudice.
